Birmingham Man Charged with Capital Murder in Shooting One Day After Jail Release


BIRMINGHAM — Malik Quintawn Austin, 24, has been charged with capital murder in connection with the shooting death of 21-year-old Tre’Von Nyheim Douglas on February 15, just one day after Austin was released from the Jefferson County Jail.



Austin was arrested on Monday, February 19, in the 7700 block of Crestwood Boulevard on an unrelated probation violation warrant. After being taken to police headquarters, he was interviewed by homicide detectives, and later booked into the city jail on a 48-hour hold. The Jefferson County District Attorney’s Office issued a capital murder warrant for Austin on February 20.



Douglas, who was expecting his first child, was shot just before 4:30 p.m. on February 15 in the 1400 block of 33rd Street in Birmingham’s Ensley neighborhood. Neighbors reported hearing a loud “bang” and found Douglas lying in the backyard of a home. He was pronounced dead at the scene by Birmingham Fire and Rescue Service at 4:46 p.m.



Douglas had spent the day with Austin and another man. His girlfriend grew concerned when she couldn’t reach him and, along with his mother and brother, began trying to contact him. She reached out to Austin, who only told her he had dropped Douglas off and was on his way to pick him up.



Austin’s criminal history includes multiple arrests. In September 2024, he pleaded guilty to first-degree robbery and was sentenced to 20 years but granted time served and placed on probation. He was arrested in November 2024 for possession of two pistols as a convicted felon, and again in January 2025 for possession of a stolen pistol.



Despite these violations, Judge Stephen Wallace continued Austin’s probation in February 2025, and he was released from jail on February 14, only to be involved in the deadly shooting of Douglas the next day.


Austin will remain held without bond in the Jefferson County Jail while awaiting trial.
