Woman Sentenced to Four Years for Shooting Man on Red Line Train in Chicago


CHICAGO — A 39-year-old woman who shot a man on a Red Line train in downtown Chicago after he allegedly became “disrespectful” was sentenced to four years in prison on Monday.


Erica Berry pleaded guilty to aggravated discharge of a firearm, while prosecutors dropped more serious charges of attempted murder.



The incident occurred in May 2023 when Berry was riding a northbound train around 8 p.m. Prosecutors said a 35-year-old man approached her and attempted to start a conversation. Berry told police she tried to “let him down nicely” after he began flirting with her, but he persisted.


Surveillance footage showed the man sitting beside Berry, who nudged him away twice before he moved to sit near two other women. The verbal exchange continued, prompting the two women to leave their seats, officials said.


Berry then pulled a gun from her purse and fired at the man. After he didn’t move, she fired another shot, hitting him again as he attempted to flee through the train doors, according to prosecutors.



A security guard at the Roosevelt station heard the gunshots and saw Berry running from the platform. Chicago police officers apprehended her about a block from the station and found a .22 caliber revolver in her purse.


The victim required surgery for gunshot wounds to his left hip and right elbow. Berry’s attorney argued that she may have acted in self-defense or in defense of the other women on the train.


Judge James Obbish sentenced Berry to four years in prison, with the sentence reduced to two years for good behavior. She will also receive credit for 632 days served while in custody awaiting trial.
